1. Introduction

Welcome to MiziGo Pap, an online parcel delivery platform operated by AllPro Company Limited. By accessing or using our services, you agree to comply with and be bound by the following Terms and Conditions. These terms govern your use of our platform, including the rights and obligations of users, drivers, and owner-operators.

Key Definitions:

  • “MiziGo Pap”: The parcel delivery platform owned by AllPro Company Limited.
  • “User”: Any individual or entity that uses the platform to send or receive parcels.
  • “Driver”: Individuals or entities that provide parcel delivery services through the platform.
  • “Owner-Operator”: Businesses or individuals that own vehicles and contract with MiziGo Pap to provide parcel delivery services.
  • “Platform”: The MiziGo Pap mobile app and/or website.

2. Acceptance of Terms

By using the MiziGo Pap platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including our Privacy Policy. If you do not agree with any part of these terms, you must discontinue using our services.

3. User Responsibilities

Users of MiziGo Pap are responsible for:

  • Providing accurate information regarding delivery details (parcel content, size, destination).
  • Ensuring that parcels are packed securely and comply with legal and safety regulations.
  • Making timely payments for services rendered via the platform.
  • Not using the platform for illegal activities, including but not limited to the transportation of prohibited or restricted goods (such as drugs, explosives, or firearms).

4. Driver and Owner-Operator Responsibilities

Drivers and owner-operators must:

  • Ensure the timely and safe delivery of parcels.
  • Maintain a valid driver’s license and insurance as required by Kenyan law.
  • Provide accurate vehicle information and maintain vehicle safety standards.
  • Comply with all road safety laws and regulations.
  • Agree to the terms of service provided by MiziGo Pap, including adhering to service fees and commissions.

5. Payment Terms

  • Users are required to make payment for parcel deliveries through the MiziGo Pap platform. Payments can be made via mobile money, credit card, or other payment methods provided.
  • Drivers and owner-operators will receive payment for their services according to the terms agreed upon during registration. MiziGo Pap deducts a commission from each completed delivery.
  • Payments are processed promptly, and disputes regarding payments must be raised within seven (7) days of the transaction.

6. Data Protection and Privacy

MiziGo Pap values the privacy of its users, drivers, and owner-operators. We are committed to protecting your personal data in compliance with the Data Protection Act of 2019, Kenya.

  • Data Collection: We collect personal information such as names, contact details, location, and payment information solely for the purpose of facilitating parcel deliveries.
  • Data Use: Your personal information will be used for operational purposes, including matching users with drivers, processing payments, and improving our services.
  • Data Protection: We use industry-standard security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction.

7. Intellectual Property

8. Limitation of Liability

MiziGo Pap, AllPro Company Limited, and its affiliates are not liable for:

  • Delays or failures in parcel delivery caused by circumstances beyond our control, including but not limited to accidents, natural disasters, or road closures.
  • Loss, damage, or theft of parcels unless it is proven to be due to the negligence of MiziGo Pap or its agents.
  • Any indirect, incidental, or consequential damages arising out of or related to the use of the platform.

9. Termination

We reserve the right to suspend or terminate access to the platform for any user, driver, or owner-operator who violates these Terms and Conditions or engages in illegal or improper conduct. In the event of termination, all pending payments for completed deliveries will be processed accordingly.

10. Amendments

MiziGo Pap reserves the right to amend these Terms and Conditions from time to time. Users, drivers, and owner-operators will be notified of any material changes. Continued use of the platform after such changes constitutes acceptance of the amended terms.

11. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Republic of Kenya. Any disputes arising from these terms shall be settled through arbitration in Nairobi, in accordance with the Arbitration Act of Kenya. Parties agree to first attempt amicable resolution before pursuing arbitration.
